A 20-year-old Victoria man was convicted Feb. 20 of petit larceny and tresspassing and was sentenced to two years in prison with all but six months in jail suspended.

According to Commonwealth’s Attorney Robert Clement, Shane Moore was originally charged with burglary of Victoria Restaurant, but a plea deal was worked out when identification proved to be an issue.

According to a summary of evidence provided in court, the incident leading to his arrest arose Sept. 23, 2017 in the Town of Victoria when the door to the restaurant was found to have been broken in sometime during the night.

“A surveillance camera captured the offender, but the full face of the thief was blocked from view,” officials said in the release. “Local police identified the person in the photo as Moore based on the partial view of the lower part of his face and his body. Evidence showed that Moore took $170 from the register. Moore was arrested but refused to make any statements regarding the matter.”

Moore had no prior adult criminal record. In addition to his sentence and fine, Moore must be of good behavior for two years, complete supervised probation for one year, abstain from illegal drugs, pay restitution for the stolen money and the damage to the door in the amount of $419 and submit to warrantless searches and seizures.
